1. Rules
The Terms and Conditions stipulate the terms under which the WESTAFRIC service is provided and define the rules for the participation of individuals or entities enrolled in said service.
The provision of the WESTAFRIC service is dependent on the full acceptance of these conditions, so any user who does not agree or does not undertake to behave according to these will not be able to use said service.
The interpretation of these Terms and Conditions is exclusive to WESTAFRIC, which reserves the right to modify them at any time.
2. The WESTAFRIC Service
1. WESTAFRIC is an online service that provides users with an Internet site with the aim of facilitating the disclosure of intentions to sell or contract products, services or interpersonal communication through a classified system.
2. WESTAFRIC does not have access to or control over the articles or conditions of services communicated in the advertisements nor does it engage in or participate in the actual transaction between buyer / contractor and seller / supplier. Therefore, WESTAFRIC does not guarantee the quality, safety or legality of the advertised articles or services, the truthfulness or accuracy thereof, the ability of sellers and suppliers to sell goods or services, buyers' ability to purchase products or contractors to contract services, nor can it ensure that both parties complete the transaction.
3. Access to the service
Since WESTAFRIC has no uniform content, it is not possible to restrict access to the service only in accordance with the age of majority.
The legality of access to the service is dependent on the fact that no contracts of any kind, whether expensive or not, are carried out under WESTAFRIC, so that access to the service is allowed to users, regardless of their total legal capacity. of these. Not having a mediator of transactions, WESTAFRIC is not responsible for any eventuality resulting from the lack of legal capacity of the users.
Any interested party may only match one record and WESTAFRIC may cancel any subsequent registration made by the same individual.
Entries in WESTAFRIC are personal and non-transferable, and the holder of the registration is solely responsible for the actions taken with his registration.
4. General Terms of Use
1. It is allowed to place an advertisement related to a particular item, property, vehicle or job vacancy. The same advertisement can not be the subject of more than one subject to be announced;
2. Advertisements that contain word manipulation or that are attributed to inappropriate categories may, according to these terms of conditions, be targets of measures that include their definitive removal;
3. WESTAFRIC is not responsible for the content of the advertisements, hyperlinks or sources mentioned in the description of an advertisement, with the responsibility parameters for content and links described further below in this document;
4. WESTAFRIC may remove or edit the descriptions placed in an ad by users, without having to mention the cause of the advertisement;
5. WESTAFRIC may exclude you from using the service (eg, prevent you from logging in, from placing or responding to advertisements), when you have violated any of the terms of this term of use in this document;
6. WESTAFRIC strives to operate properly without fail, but reserves the right to temporarily suspend its operations for technical reasons, or causes beyond WESTAFRIC's control;
7. WESTAFRIC is not responsible for the behavior of advertisers, or items and services advertised by them for sale as described in their advertisements. By infringing the rules in force in WESTAFRIC in a particular announcement, the user will assume all responsibility resulting in damages or losses to any entity, natural or legal person, and WESTAFRIC is exempt from any resulting liability;
8. WESTAFRIC shall not be liable for any damages that occur as a result of a transaction or improper conduct of one of the parties to the transaction;
9. Messages and their attachments stored in My WESTAFRIC remain on the system for a period of 90 days.
5. Responsible Use Term
1. In order to ensure a high quality of service to all users, to prevent abusive situations or to jeopardize the performance of the service provided, WESTAFRIC may apply a policy of responsible use, limiting the free placement of advertisements in certain categories.
2. In cases where this policy is applied, a notice will be issued when placing the ad and you will have to opt for a purchase mode for additional ads. Alternatively a service that is more suitable for professional use may be recommended.
6. User responsibility
By accepting these Terms of Service, the user undertakes to:
1. Provide and maintain true, complete and up-to-date personal data;
2. Keep the access data to your WESTAFRIC register confidential and use only the register of which you are the holder, assuming full responsibility for the actions carried out with that register, even if by third parties, with or without your authorization;
3. Adopt only conduct that does not infringe the current legal order or which in any way damages legally protected positions;
4. Do not submit offers to buy or sell articles or contracting or providing services or communication of illicit products or services or violent, provocative, offensive, racist or likely to violate the privacy or rights of others;
5. Comply with all obligations arising from the purchase and sale of articles and provision and contracting of services communicated through your ads on WESTAFRIC;
6. As an advertiser, assume full and exclusive responsibility for the accuracy of the ad data and its suitability for the content of the advertisement, as well as liability for the legality of the advertised article or service.
WESTAFRIC does not undertake to verify or approve, in a binding or systematic way, the advertisements placed on the site by the users: these are placed online automatically and without any interference or control on the part of WESTAFRIC.
Ads integrated into the WESTAFRIC system, however, must meet the following basic requirements at the advertiser's responsibility:
1. Be placed in the category most indicated to the product, service or offer;
2. The ads placed in WESTAFRIC, should only be referring to Offer and / or Sale, not accepting ads of Search;
3. Advertised articles and services may not be burdened by third party rights; must be available immediately (thus, it is not allowed to sell articles that are not in the direct possession of the advertiser, and also reserves of animals for future delivery are not accepted);
4. Do not include any article appearing on the following List of Prohibited Items:
(a) Firearms and ammunition - guns whose use and possession require a license or prior legal authorization are not permitted.
b) Illegal copies - copies, duplicates or "backup copies" of computer programs or audiovisual articles, including memory cards or other storage devices that offer or include, as part of the business, such copies;
c) Drugs, narcotics and tobacco;
d) Equipment for the unblocking or visualization of encoded video signals - according to Portuguese law currently in force (namely through Decree-Law 176/2007 of 8 May), it is illegal to "acquire, use, own or hold title "of devices that allow unrestricted access to conditioned, ie, coded services that require a payment for their viewing, such as for example Zon or MEO encoded channels;
(e) fireworks and derivatives;
f) Alcoholic beverages;
g) Medicines or medical / pharmaceutical tests;
h) Pyramid / multi-level schemes;
(i) Animals whose sale is not in accordance with current Portuguese legislation, in particular all specimens listed in the CITES Annexes, in particular Annex IA, must be certified, even if they are antiques (Decree-Law No 114 / 90, of April 5, Ordinance No. 236/91, of March 22);
j) Modchips / Jailbreak;
k) Affiliate programs / rewards or commissions and / or business partnerships;
l) Non-explicit offers to make money / monetize time / work from home;
m) Human organs;
n) Replicas and counterfeits;
o) Craft manifestations (for example necklaces) without proper registration (National Crafts Registry);
p) Specifically with regard to Job offers, the ads should be placed in the most relevant sub-category, taking into account their content and the functions to be performed by the contracted professionals;
q) Tarot, Horoscope and / or Seers services;
(r) digital goods (eg gaming accounts / online services, unsupported software, software registrations / licenses, ebooks, electronic vouchers);
s) Vouchers, vouchers and cards of any kind;
t) Timeshare offers;
u) Equipment for games of chance, as described in Decree-Law no. 422/89;
5. Notwithstanding the above, it is not allowed to advertise content that violates the legal rules, social welfare, rights of third parties or that contains in particular:
a) Vulgar or offensive content;
b) Content that violates the rules of social etiquette;
c) Content that promotes hatred and violence, racism, xenophobia or conflicts between nations;
d) False or dubious information;
e) Virus or any other technology that could harm other users or even WESTAFRIC as a service;
(f) advertising services which compete with WESTAFRIC or not;
g) Explicit content for adults and / or over 18. We also do not accept any kind of pornographic content.
h) We do not allow any objectionable sexual content on our platform, or abusive use by Users, who post such ads.
i) Placement of means of contact (email, link / URL, telephone) in the title, description or photographs associated with the advertisement;
(j) generic, catalog and / or edited photographs which are not representative of the good actually being sold;
k) Advertisements that do not use the Portuguese language;
l) Placement of tags, keywords or other terms in the title, description or images of the advertisement that have no relation to the article / service being advertised;
n) The advertised Job Offer announcements must always refer expressly to the M / F Symbol and must refrain from indicating any preference for one of the sexes, in accordance with the provisions of articles 24 and 30 of the Labor Code, approved by Law no. 7/2009, of 12 February.
o) The advertiser is responsible for complying with these requirements, and WESTAFRIC may cancel or delete without notice and at any time advertisements that do not comply with the rules set forth above.
p) Advertisers authorize WESTAFRIC to freely use the content corresponding to the advertisements for the purchase and sale of goods and contracting or providing services (for example, in advertising promotions).
8. Notifications
Users agree to receive WESTAFRIC newsletters as well as notifications related to WESTAFRIC, including any changes to these Terms of Service, to the email box associated with your registration.
9. Terms of placement of paid highlights
1. The placement of ads with paid highlights is dependent on prepayment, in the terms defined in our Tariff, which is an integral part of these General Conditions of Use. Linking individual highlights does not change the normal duration of ads (duration of 4 - four - weeks). The duration of the highlights depends on the chosen duration, which can range from 1 (one) to 4 (four) weeks;
2. At the end of the period referred to in Point 1, the User may renew the advertisement for an equal period, making the prepayment under the terms defined;
3. The conclusion of the business before the expiration of the period of placement of the advertisement defined in Point 1, does not give the User the reimbursement of any amount for not using the advertisement up to the maximum of its duration;
4. Advertisements must comply with the conditions indicated in the "Content and Advertisements" section of the Terms and Conditions of Service;
5. Any advertisement which does not comply with the conditions required or in any way damages the normal operation of the Service Provider's website may be withdrawn, canceled or deleted;
6. You may, at any time, edit active ads through the My WESTAFRIC area, being prevented from changing the category of the advertisement;
7. The User may at any time delete active advertisements without any right to reimbursement of the amount paid for the placement of the advertisement on the Service Provider's website;
8. For security reasons, the Service Provider may postpone the listing of advertisements (new or later edited by the User), User contacts and annotations or images of the advertisements and, if they do not meet the required conditions, the ads may be deactivated or deleted without notice;
9. Amounts paid for optional highlights, advertisements and Packages are not refunded or refunded in any case, including in case of termination of use of the WESTAFRIC.COM service;
10. By placing the advertisement on the Service Provider's website, the User grants to the user all rights to the text and images used in the advertisement and authorizes the user to use the texts and images of the advertisements for promotional or advertising purposes;
11. WESTAFRIC reserves the right to remove images, used in First Page Featured Ads;
12. First Page Spotlight ensures rotating exposure on WESTAFRIC homepage (provided you have an ad-related image), search results for the ad category and region;
13. Ad editing is not allowed as long as it encounters Active Featured Highlight.
1. The IP addresses of all connections to WESTAFRIC are registered. This information will be used to perform aggregate statistical analysis.
2. The information will be analyzed in an aggregated and anonymous way. The data used for this purpose does not contain personal identification data or private information.
3. Analyzes made from aggregated statistical information will be made to interpret site usage patterns and continuously improve service levels and user satisfaction. The aggregate statistical information resulting from the analyzes may be disclosed to third parties or publicly.
